Dropped a customer off at her house this morning. Headed back towards work jammin down listening to the country station. Get into traffic so the nice guy that i am i never block an entrance to a street or business. So i left open a gap liek always , even check behind me to make sure the guy back there didnt have a signal on. Waiting for traffic to clear i sip my coffie. Put my coffie back down , looked out , hey ...IM MOVING....I thought "maybe im not on the brake hard enough". Push the brake down , slight jolt ...Still moving....Look back , theres why , im being pushed by these two trashy women in a old ford ranger. Tossed the van in park , jumped out and walked to them. They slam into reverse , go up and over the curb , thru some bushes and out thru the lot they wanted to go in and cut out onto the street. Apprently to get around traffic , which is very illegal.

Took off to fast for me to get the plate , and with the van stuck in park i got nothing to give chase with. Rocked the van a bit by hand and heard a thump. Vans fine ....Head the rest of the way into work , everything inthe rear look fine , 2 new scratches , and the plastic ont he sides that snaps in isnt alinged right ....Not much can be done about it so we are gonna let it go ...

But talk about weird ....

ballisitc mode is gone ...i dont know what happend to it ...like that guy in the neon the other day ...i just got out to see what the deal was ....same with these 2 white trash treasures ....it was like "wait a second i need to see this"...not "time to kick some ass!" ......

I'm not sure I would know what to say to them... that's such a weird situation that it is a bit shocking. Since the van isn't that bad and it wasn't a Caddy, it's kind of funny really.

Be careful here in Florida. New gun laws. If they feel there life being threatened by you, the can just shoot now instead of trying to get out of the sitution first.

Thats from what I understand the law is now. I have also be told that every round you shoot expect to pay $20,000 per round shot to get a good lawyer to get you off.

There must be presumption of fear of death or great bodily harm in order to use deadly force. I don't know about the $20k rule of thumb (see 776.032-3 below), but selling the fear of death or great bodily harm to a jury takes a good lawyer even when the case seems cut and dry. If my life was in the hands of a jury of "my peers" I wouldn't be using the services of a public defender.

One may carry a secured firearm in FL without a concealed carry permit. "Secured weapon" is a VERY loose term in FL.



776.041 Use of force by aggressor.--The justification described in the preceding sections of this chapter is not available to a person who:

(1) Is attempting to commit, committing, or escaping after the commission of, a forcible felony; or

(2) Initially provokes the use of force against himself or herself, unless:

(a) Such force is so great that the person reasonably believes that he or she is in imminent danger of death or great bodily harm and that he or she has exhausted every reasonable means to escape such danger other than the use of force which is likely to cause death or great bodily harm to the assailant; or

(b) In good faith, the person withdraws from physical contact with the assailant and indicates clearly to the assailant that he or she desires to withdraw and terminate the use of force, but the assailant continues or resumes the use of force.

776.032 Immunity from criminal prosecution and civil action for justifiable use of force.--

(1) A person who uses force as permitted in s. 776.012, s. 776.013, or s. 776.031 is justified in using such force and is immune from criminal prosecution and civil action for the use of such force, unless the person against whom force was used is a law enforcement officer, as defined in s. 943.10(14), who was acting in the performance of his or her official duties and the officer identified himself or herself in accordance with any applicable law or the person using force knew or reasonably should have known that the person was a law enforcement officer. As used in this subsection, the term "criminal prosecution" includes arresting, detaining in custody, and charging or prosecuting the defendant.

(2) A law enforcement agency may use standard procedures for investigating the use of force as described in subsection (1), but the agency may not arrest the person for using force unless it determines that there is probable cause that the force that was used was unlawful.

(3) The court shall award reasonable attorney's fees, court costs, compensation for loss of income, and all expenses incurred by the defendant in defense of any civil action brought by a plaintiff if the court finds that the defendant is immune from prosecution as provided in subsection (1).
