Going to Court Tonight..... Wish me Luck.....

I'm fighting a Careless Driving ticket I got about two months ago. I was driving home on I-80 at about 2:30 in the morning and in all honesty going no faster than 70 MPH since I had just totaled my Malibu a couple days before and was still in that post accident state of driving when I almost rear ended a cop car who pulled out into traffic without his headlights on. He then pulled me over and ticketed me for careless driving accusing me of flying up behind him.

I'm asking for everyone to wish me the best since this is a real injustice done to me and I want my true justice.....

I have a solution, unfortunately the law doesn't look too kindly upon justice served with 180 grains of copper jacketed lead. There's a reason I have a general dislike for law enforcement.
Unfortunately, I think you'll lose this one. His word will carry the tone of the courtroom - he'll maintain that you ran up his butt (and you admit to being over the speed limit to start with), hence not being in 100% control of your vehicle.
I would really stress the no lights on police car. The charge against you may involve a subjective evaluation of your driving conduct by the officer. For example, if you are charged with "careless driving", the officer will have to describe conduct which was in fact "careless". It may be possible to counter with an explanation for your driving conduct, based upon events beyond the officer's awareness - like you didn't see him with NO LIGHTS and which may even be consistent with what the officer has described. I assume there was no accident.

Good luck. I sincerely hope you can get out of it easily. After reading a story (a week ago) about a judge who jailed 3 men that showed up in his courtroom wearing shorts, I don't hold much faith for our great justice system. 10 days for wearing shorts - :ill:

It's called contempt of court. They could have gotten as much as six months with no right to bail. My friend's Uncle Bill was before the judge for stealing the siren off a police car. After a couple of surly replies, the judge announced "I find you're in contempt of this court. That'll be two weeks in jail" Bill answered "Aw! Gee whiz judge. I was trying to conceal it as best I could". He got the six months.
Try to look as much like the average citizen as possible, if you are really in a brown nosing mood put on a jacket and tie. If you go early some courts allow you to bargain with the prosecutor. For the towns it's all about the money. For the drivers it's usually about keeping the points down which in turn is all about the money. Bargain it down to something with little or no points and pay the fine, win win, town gets the money and you save the points which saves you insurance money in the long run.

Good luck Dope. I just recently beat a case involving cops. I was in an accident with a off duty cop. 20minutes later on duty cops showed up. 10 minutes later I was in jail. It was thrown out of court because one of the arresting officers went through police training with the person who hit my car. I had a lawyer though($4000), the state's attorney and the officer who showed up had the nerve to be angry.:banghead: $4000+$500 decuctable just because a cop hit me.:cookoo: It make me wanna join their gang so I don't hafta go through this again(above the law). If ya can't beat-em, join-em.
