I have been having trouble with my fob on my 2009 STS. In order to lock the car i have to find that “sweat spot” to lock it. Remote starting is another issue, i have to lock twice then hold my hand at different angles in order to remote start it. I am wondering if my fob is worn out and needs to be replaced or if it is a problem with the car.

How old is the fob battery

Well then, ask him if he ever put a battery in it. Could be a low/almost dead battery. Or you could go somewhere and get it checked. Or it could be a failing fob, from what you are describing.

Must be playing "warmer.. warmer.." With the fob.
At any rate, you can find replacement batteries for a pretty good deal. I think I bought 4 for not too expensive and I keep the extra 3 in the center console. I've also seen electrical interference disrupt the reception of the fob signal.

Crack it open and clean the back side of the rubber buttons, check to make sure the contacts on the board surface is clean as well.
