    Hi there,

    sure you can be rude too but here in germany, you can abserve some guys in front of you on a 3 lane autobahn with no speed limit doing on the left lane 150 kph (90 miles) and no car is in front of them on the next 2 miles but they keep staying just on the left line. To pass on the right is not allowed here!

    What would you do, if you come with your XLR, Vette or other fast cars????

    Ya know, that "My time is more valuable" and "I own this lane" and "I won't move over" is one of the major reasons people shoot other folks on the highway. You obviously interpret FTP as a "demand", which is projecting your perspective on another driver. I look at it as a "request". How else can I ask you to let me pass other than the headlights? I guess I could unload my .45 into your car, but that would be impolite, too....wouldn't it?

    The whole issue about "illegality" is functionally moot. The speed limit is 65 (or whatever posted) and if you're in front and driving at 65 then I suppose you believe that no one has the "right" to go faster than you...hmmm? The only "law" we can't avoid is death (and taxes...maybe gravity, too). The rest of the crud on the books is all optional.

    Oh, and from MY perspective, my time IS more valuable than yours...as I'm sure you believe your time is valuable, too. So, it's all in how you look at it, isn't it? And if you're the kind of person who can't deign to respond to a request, you're the kind of person I pass on the right, cut off, and present with a digital salute. Hey, that's me projecting MY opinion on another driver, too.....

    Technically, you can get a ticket for flashing your lights for anything in NJ. If you flash your lights at one of the left lane jerks, the cop can give you a ticket, even though there's a law against staying in the left lane for a prolonged length of time. The cops here don't ticket them, though.

    I guess I should have expected an idiotic response from an idi__ well,,,,,you get the point. BTW - That ".45" you are going to unload into my car, is that the total number of IQ points you have at your disposal? And you admit to utilizing hand signals. I'm glad they are still funding that program at the zoo, every monkey needs to to be fluent in stupidese.

    Great response John, as always it's entertaining. I am disappointed though, I was hoping you would at least have the courage to stand by your own convictions. Referencing your comments as sacasm at this point leads me to only one conclusion - not only are you lacking in intellect, you are a bit cowardly too, verbally speaking, of course............

    Let me get this straight. My mother is at the hospital dying, I come up behind you in the fast lane. You don't think it's your time to move over, so you block me in. Either my mother dies before I get there or I have to unload a .45 into your trunk to get you to move.

    I come up flashing my lights at you, I expect you to move over if its safe for you. If its not safe, I don't expect it.

    Lets not forget, theres allready a precident in California now, where this happened. A guy was going faster then the car in front. He beeped his horn, flashed his lights, but the front guy wouldn't move. So the faster driver accelerated and rode the front guys ass. Front guy brakes hard, causes accident. Now, you'd assume full fault is implied on the rear driver, correct? Wrong, with the help of the EDR, they're bringing evidence out that the guy in front was driving below the speed limit.

    FTP is a courtesy feature. Be a little courteous.

    I would give your position some credit if you could produce a solid fact. Can you provide a link to a location where I can verify your story? If you cannot provide that, then can you at least tell me in which jurisdiction this occurred? With over 30 years of law enforcement experience in the state of California I find your story hard to believe, since I know there have only been a small number of cases where data from the EDR was used.

    California law enforcement decided long ago that the data would only be utilized in cases of vehicular homicide, or where the car was used as a weapon and a death resulted -(see CVC section 9951). The data is admissible in some civil cases at this point, however the cause of an accident is identified and documentd by the investigating law enforcement agency, hense, no death, no EDR data. Based on the facts you presented, no matter what the data said, the trailing vehicle is at fault; driving below the speed limit is a violation in some cases, however it cannot be a primary collision factor, it would only be a contributing factor.

    Drivers who fail to allow for a safe stopping distance are always at fault, unless you can show intent. The EDR data cannot and will not ever prove that. Afterall, can the EDR data see an object in the roadway that forced the driver to brake hard? In fact, in both a criminal or civil case, the actions of the trailing driver would constitute elements of "road rage" and as such would overshadow any other factors.

    As for unloading your .45 into my trunk, well you most likely know what i think of that idea. Anytime you or anybody else feels they have the right to use lethal force to achieve their goal, you lose total credibility, even if you are trying to be sarcastic.
