best part is, when they take it and auction it off for pennies they will sue for the difference between the sale price and the amount owed, plus court costs etc. 1k will look cheap compared to the bill the sheriff will bring

So how do I suppose to feel about all that ?
It gets even better. My insurance agent told me that they requested copys of my policy and he faxed them over long time ago. And he can prove it. My lawyer said that I have a very strong case against them.
I was over at the dealership today where I got my car from, and sales manager told me that their 2 Escalade owners going through the samething with GMAC. and she was very pissed, because one of them wants to trade his Escalade for the newer one, and they cant close the deal because of that issue.

As said a few times already.....Big time screwed when stopping payments, no mater what the circumstances.
Just giving them even 5 dollars would have been sufficient to keep them at bay until they finally figured it out.

BTW ???
Did your lawyer, that you say you have looking at this, recommend that you stop payment ??

when he gets sued by gmac, he may have a countersuit claim if he's got great documentation of the insurance transactions. trouble is all that will cost way more than a grand

These are not times to be playing games with things that might affect your credit rating.
Paid of loan or not, mistake or not, if this goes to your credit your score will be in the tank and trying to get a decent loan at a decent rate with the changes taking place in the lending industry is financial suicide.
Your attempt to "show them" is going to backfire in the worst of ways.
If I read this right (and I may not be) you may even face criminal charges for hiding the vehicle, for whatever your reasons are.
I'd agree with the overall consensus of this topic, no reason to stop paying, as frustrating as it may have been you should have gathered your documentation and done some certified mail or sat on the phone for 5 or 6 hours to get it straightened out. Their mistake or not you are now in a breach of contract situation and possibly a grand theft auto situation.

I hope it all works itself out.

well, my lawyer working on this mess. He said it was not very smart of me taking this kind of issue in my own hands, but it's ok. as a result, so far GMAC rep is not calling me anymore or trying to pick up a vehicle.
Usually, when people turn their car back to the bank, they don't really care where the car is towed from.
however.
1. nobody ( does not even matter if the bank owns a pink slip) can tow a vehicle from private property. without a court order, and a marshal being there at the scene.
2. Not even a police can enter your house without your permission or court papers.

It's a crime.

And you broke a legally binding contract that said you would make a payment for that car every month and if you stop doing so, the company who owns the car has the right to take it back. By not making payments and hiding the car, you're essentially guilty of grand theft... last time I checked - that's a crime too.

Two wrongs never make a right... they may help you sleep better at night, but it's never right.

many times I get a phone calls from customers who happened to be a soccer mom, or pit-bull with or without a lip_stick. telling me that they have a hard time operating their video system. so I ask them if they read the manual. they say yes we did. But we still don't understand.
first thing comes to my mind is this
Bitch, if you are so dumb, then have somebody else read it for you.
But I cant say that, because I am very polite with women. So what I say is this:
Madam, I'll be glad/happy come over to your house or work, so we can read this manual together, and solve this issue

now, back to your comments. If English is not your first language. I'll be glad/happy to translate following phrase to your native language.
I did not stop making payments out of the blue. there was a dispute prior to that. and that already been discussed in previous posts

First of all... English is most certainly my first language, thank you... and from your posts, it isn't that big of a stretch to assume that I have a much firmer grasp of it than you do.

Secondly... I've been following this thread from the beginning. I realize there was a dispute, but what you fail to realize is that regardless of any dispute, you are still obligated to send in your monthly payment. Nowhere in your lease agreement (ie - legally binding contract) does it say that were a dispute to arise, you are allowed to stop making payments all together.

There isn't a single person here who has said that you should have paid the disputed amount... Only that you were 100% wrong to stop making your monthly payment. Did GMAC make a mistake? If what you're saying is true, then sure they did... But you're the one who screwed the pooch here pal...

AMGoff, as much as it paains me, I have to agree with you 100%. Even an average bunkhouse lawyer will tell you that you have to keep making the payments. It may gripe your ass but you gotta pay.

Guys, we're going about this all wrong....he needs our encouragement!! This is so he will keep hiding the car, and then become the subject of the next series of "freecreditreport.com" ads.

Instead of him living in his parents' basement or working in a seafood restaurant, they can make one about a tool who runs around trying to hide his car from the repo man. And instead of the annoying song, they can just rhyme an endless string of excuses.

And now to contradict myself, a couple of non-encouraging points geared toward the OP:

First, your criticism of anyone's usage of English (especially AMG's) is rich -- considering the rambling nature of your posts.

And what is the deal with the sarcastic references to Sarah Palin on what is supposed to be a non-political forum?? This is in addition to the completely incomprehensible nature of that paragraph in the first place.
