I had a different point, but many took it the wrong way.
this is how its all started.
back in 2006 when I took delivery on my STS, month or two later I got a letter from GMAC asking me to provide insurance information. So I sent it right away. 6 month later I recieved another letter from GMAC about the same thing. so this time I called them and while i was on the phone with them, I faxed over same documents again.
Now, april of 2008. I recieved letter again, stating, because they never recieved any response, they had to their insurance or what they call it VSI or something like that. which is $220 a month from april of 2006 to current. and they recalculated monthly payments.
I am very upset. when I bought my first home, it was financed through GMAC. 30 years loan I fully paid in 5. then 3 times I financed my car loans and paid them off yearlier. now I have 2 more home loans from them and a car lease, and I never been late.
So how do I suppose to feel about all that ?
It gets even better. My insurance agent told me that they requested copys of my policy and he faxed them over long time ago. And he can prove it. My lawyer said that I have a very strong case against them.
I was over at the dealership today where I got my car from, and sales manager told me that their 2 Escalade owners going through the samething with GMAC. and she was very pissed, because one of them wants to trade his Escalade for the newer one, and they cant close the deal because of that issue.

Paid of loan or not, mistake or not, if this goes to your credit your score will be in the tank and trying to get a decent loan at a decent rate with the changes taking place in the lending industry is financial suicide.
Your attempt to "show them" is going to backfire in the worst of ways.
If I read this right (and I may not be) you may even face criminal charges for hiding the vehicle, for whatever your reasons are.
I'd agree with the overall consensus of this topic, no reason to stop paying, as frustrating as it may have been you should have gathered your documentation and done some certified mail or sat on the phone for 5 or 6 hours to get it straightened out. Their mistake or not you are now in a breach of contract situation and possibly a grand theft auto situation.
I hope it all works itself out.

He said it was not very smart of me taking this kind of issue in my own hands, but it's ok. as a result, so far GMAC rep is not calling me anymore or trying to pick up a vehicle.
Usually, when people turn their car back to the bank, they don't really care where the car is towed from.
however.
1. nobody ( does not even matter if the bank owns a pink slip) can tow a vehicle from private property. without a court order, and a marshal being there at the scene.
2. Not even a police can enter your house without your permission or court papers.
It's a crime. |

Secondly... I've been following this thread from the beginning. I realize there was a dispute, but what you fail to realize is that regardless of any dispute, you are still obligated to send in your monthly payment. Nowhere in your lease agreement (ie - legally binding contract) does it say that were a dispute to arise, you are allowed to stop making payments all together.
There isn't a single person here who has said that you should have paid the disputed amount... Only that you were 100% wrong to stop making your monthly payment. Did GMAC make a mistake? If what you're saying is true, then sure they did... But you're the one who screwed the pooch here pal... |

Even an average bunkhouse lawyer will tell you that you have to keep making the payments. It may gripe your ass but you gotta pay.
