Interesting theoretical situation: If a dealer finds out that an owner was driving over 100 mph and a major part on car fails, can a dealer refuse the make the repairs? I wonder if dealer can consider those actions "abuse of car?"

Any attorneys out there with an opinion?

Again, theoretical situation. I thought of this after reading some threads on another performance forum.

they would have to prove that not only you were doing over 100mph..which they legally can't do...only a court system can, then they also have to prove that it was the excessive speed that caused the part to fail....they'd most likely fix it...maybe a little arm twisting, but it'd get done.

Im not a attorney, but i play when picking up girls at a bar.
I would say no, heck you can abuse a car at 30mph. If Gm thought that 100mph would abuse a car then they would speed limit the car for that. Now if the car was set for 100mph and you remove the speed limiter then i say yes, you have abused the car. Can you give more info into what you are looking at.

There are no legal grounds to stand on in a situation like this and you are covered by the fact that they could not prove when and where the part failed! I would win that case in a heartbeat!



P.S. I am not an attorney but I did stay at a Holiday Inn last night!

Damn. I thought I knew it all. Oh, well, I learn something everyday. I do a lot of HR work, and I am always in the middle of some type of legal question.

Well actually, someone a while ago posted a story abut how someone took their WRX or some little rice rocket like that to an autocross. They raced the car and blew their engine at said event and when they took the car back to the dealer, the dealer had found that the car had been registered for racing at the autocross and they refused the warranty work. I wish I could find that link here...

Just something to consider.

Virtually every warranty becomes 'Null and Void' if the car is used for (formal) racing - which in this case seems to be the fact which the rather cloth-headed WRX owner seems to have been unable to fathom....

Also, the event recorder keeps abot 20 seconds of data prior to an "event", so if one was going over 100 mph when the event happened, that information is there.

The dumbest thing to do is brag about how your car quit or failed while racing.

Especially to the service dept!
