View Full Version : some1 rear ended me and ran away!!!! CadiKing2006 10-09-06, 02:00 PM I Still cant believe it. I was in the car driving and some person backs up from his driveway and rear ends me. When I get out and walk towards him and revs and takes off in his car.
I called the cops and they said legally I cant do anything b/c I cant Identify him. This sucks so much. I said what if I say I cant identify him and the cop says well what does he look like then.
I went to his house today and talked to his wife and he wasnt at home. Im not gona let this go. The cop even said to me legally u cant do anything but you could stay in the limit and try what ever possible to get him to fix this.
If nothing works. Im gona have to pay for this my self. Where do I get parts and what needs to replaced here. Thanks alot every1

The good news is that's not too bad. You'll need a new taillight and bumper cover- the trunk can be fixed with a little filler and sanding.
Check Ebay for the parts, I've seen lots of CTS taillights there (they're exactly the same as ours) and perhaps the bumper cover too. Paint on the bumper cover should run between $300-$400 for a good job, and figure another $300 for the decklid. The taillight you can install yourself.
I'd guess around $1,000 for the whole job, so depending on your deductible, you may not even want to claim it. Even if you aren't at fault, they'll still try to give you the ole' Captain's Mast after filing a claim.

Short of calling the Insurance Company and starting a paper trail that "could" lead to a claim and a higher premium next year, I'd call a legal aid outfit and get them to draft a letter on fancy stationary and send it to him registered mail or better yet, by messenger.
The letter should ask how he will address the damage he has caused and that if you do not have a reply legal action will ensue...
It'd be a good start anyway.

Its not a questions of whether he can identify the car that hit him, the question is whether he can identify the driver. From the sound of it, he probably can't identify the driver...at least not until he sees him come home one night...... I would hope the laws in Canada aren't that different. It should be easy enough to look and see damage on his car that matches the damage on yours in front of a police officer. Even if he denies he was driving you should be able to track it to his car. Chef - Let us all know how this works out. There has to be a way to recover the damages. The law in the US is the car and car insurance cover the loss regardless of the driver. It's the same way if I let a friend drive my fully insured vehicle. He's covered under my policy now. This is of course hoping that the drive does in fact have insurance. I never did find her and ulitmately paid to have the car fixed myself (White Diamond tri-coat metallic = $$). The cops did go look for her, but since I was in a dead OnStar area it took a good 5 minutes to drive around to get enough signal to talk to a dispatcher (thanks, OnStar!). By that time she was long gone and laughing all the way.
Since you know where this SOB lives you CANNOT let it go. You need to avenge all those who have been hit and run upon.

My insurance company does not raise rates unless the accident is over 50% your fault. They will fix your car and go after his insurance. Doesn't matter who was driving his car, insurance companies insuer cars not people.
