On May 29th I bought a 2003 Cadillac Escalade from SouthPark a local Cadillac Dealership in Edmonton as a Optimum Inspected vehicle that came with a 3 month or 5000km warranty. Well I brought it back that week on a friday that week with a problem with my drivers/passengers front windows. The windows would roll down, but when you wanted to roll it up they would stop half way and you would have to press the window button about 10-15 times for them to roll up all the way. They told me they could look at it the following week on a Tuesday. But i told them that on Sat I was going on a vacation to the states and that by the time I got back I would be off warranty. So they said that it would be no problem, that thay could look at it when I get back. Well about 1 hour after I left there, I had a check Engine light come on. I called them about it and they told me that they would look at all the problems when I get back. So I was OK with it.
Well I was in Nevada and I had problems with my motor. The motor wasn't running right. So I brought it to a Chevy Dealership to get it looked at. When I came there, I talked to the service guy about my motor and I told him I was still under the Optimum warranty. So he looked it up on their computer and told me that there is no warranty on the vehicle in the system. I showed him my Warranty book, but he said it has to be in the system in order for them to look at it under warranty. That it would be in my best option to have the dealership look at it where I bought it from because of the warranty.
So I get back to the dealership I bought it from and they deny my warranty. They tell me that the windows aren't covered under warranty until they totally stop working. All my windows are is an inconvenience that's all. On top of the windows problem my transmission is leaking. I checked the dip stick and it's overfilled by 1/2" past the full line marked "Do Not Overfill". Plus my back-up sensors aren't working, aftermarket intercooler resevoir is leaking like crazy, and the gauge panel has to be reprogrammed.
Well they deny me warranty for all these because my warranty ran out. So I call GM warranty to complain, and they tell me I have no warranty on record. The dealership never sent in my warranty papers so I never had it put in place. So now I ran out of warranty before I could even use it. That is why the dealership in Nevada told me there is no warranty on record back then when i needed it. And the Southpark (dealership purchased) won't do nothing about it. To me it's like someone giving you a coupon two days after a sale. What good was my warranty if I could never use it.
Now I am fighting with Southgate, Cadillac warranty department, and GM warranty department.
Is there anything I can do? Any help is greatly appreciated, and sorry for the whole novel I wrote. But the dealership is at fault for not sending in the paperwork, how else can you get anywhere. This isn't a factory backed warranty. The warranty is only good at the dealership you purchased the vehicle from. Also the warranty only covers lubricated parts of the engine and transmission (powertrain only). Power windows and locks are mechanical or electrical and will only be covered under a factory backed (General Motors) extended warranty. The only argument you have is with the selling dealer, not GM. You need to speak to the general manager of the dealership and threaten to contact a lawyer and the press (local newspaper or television news channel). Because you just purchased the vehicle they should do something for you but they really don't have to. I'm interested to see what happens after you threaten them with that. Let me know what happens. It's called "GM Optimum warranty" I bought it from SouthPark Pontiac Buick Cadillac GMC Edmonton, Alberta. And the warranty I got with the vehicle is a "Bumper to bumper" coverage for 3 months or 5,000km which ever comes first. This warranty is good anywhere in North America. After arguing with the dealership, the optimum warranty department, and the Cadillac warranty department I have to wait till next Tuesday for a head guy from the warranty department gets back from vacation. The reason I know the warranty is good at all Cadillac dealerships is because I went to another Cadillac dealership and they would do the warranty work if the warranty papers were sent in to GM. you're not nuts, he made a similar thread in the "open letters" forum Caveat emptor. I hate to hear about your problems. It sounds like that vehicle had existing problems when you bought it. That is why I advocate having pre-owned vehicles inspected by another dealer or mechanic to protect yourself. And this sort of thing is why I invest money in long term extended warranties.
I hope things work out for you. I would appeal (another word for ''become a PITA'') to the person who handed you the warranty papers when you bought the vehicle. I would get in their face and make them responsible for the promises they made you to get you to buy.....after all they owe you an explanation for why there is no warranty coverage. I hope for your sake this is just an honest mistake and they fix things for you. You must be persistant, and if need be a royal PITA to the salesman and sales manager who issued you the warranty papers.

The sales man, service department, cashier, janitor, lot porter, warranty manager and receptionist can not and will not help you. Grab all of your documents, make photo copies of everything and discuss, without being an ass your case with him. If you yell and scream, and act like a 5 year old, you can bet you won't get priority. If you act like a professional and request his assistance indicating that you chose him and his dealership to purchase a vehicle and extended warranty from his place of business, he should and will usually help out. Explain what happened, and make mention that when an good deed happends 3 friends hear about it, when bad experiences happen, 50 people hear about it. He knows this line, and probably doesn't like to hear it. But you do definately need to start with the General Manager. BlownEscalade 06-24-06, 02:50 AM thanks for all your help guys. I have worked for GM in the US for over 10 years now, never heard of "optimum". My research shows it's a GM of Canada thing.
Maybe it is covered in the US, but what I stated in the other topic I responded in was basically this.
In the paperwork they give you it is spelled out what's covered and what's not. They kind of shafted you if they didn't write your vehicle up when it was still in the warranty period. If they did then you might have a leg to stand on. I am not an expert on the North of the Border legal system either.
My opinion would be, if the items you wanted addressed are specifically listed in the warranty coverage items and the vehicle is even barely out of their extended warranty then they should help you out.
I would agree with acting like an adult, no matter how upset you get. Avoid using profanity if possible and speak to the GM or the dealership owner.

IMO if they offered you any kind of warranty to close the deal on a sale they have to make good on it, or they owe you an explanation of why they won't honor it. I think I may catch a little fack for this ,but here goes.If all else fails in your case with the warranty company/dealership you may just want to make sure you have enough insurance and make it "go away". Start over with a different one. just my two cents | |
