so have you ever had a sucesfull deffence and won in court agains a tiket or driving offence
if so tell how you got out of it
or how you got it settle as not guilt

for me there was one time about 8 years ago not sure if they are still letting this run in court as a defence or not maybe it was just an Ohio law perhaps

but i had a speeding tiket for doing 94 in a 65
well i know i was speeding but i also know for a fact i was not doing 94 i was doing 74
i called my juvy laywer who els went into court with me when i was younger asked him if knew anything about trafic laws
he said before i use this deffence find someone with a radar or speed gun and have yourslef clocked to make sure your speedometer was not off
i got clocked at 64 and my readout on the dash was saying 64

he said ok now thats down
and good

when you go into court first plead not guilty then they will give you another court date when the cop who wrote you up will be there as a witness and all

he said at the cout date hope the court room is crowded
your representing yourself so you have the right to speek with the Prosecuter and ask to come up to the bench to talk with the majestrate or judge at the time hearing the case
make sure you don't blurt it out and when you are close near or 1 on 1 let the proscuter know that you don't want others to hear this in deffence because if it comes back that it is true then every other person he gave a tiket to has the right back to there fine and have there case
dis banned

tell the prosecuter and the Judge that you would like to see the last time this Office was certified on Radar and last time the radar or speed gun was calibrated if it is off by even 1 day then then every tiket that cop rote form the time the certificartion or calibration was expired would be null and void

now the judge could screw u on the fine if it comes back that they where certified and calibrated on time
they can screw you on the fine for just costing them more time
but if it comes back 1 or the other is off by 24 hours or more
then the tiket is null and void

so i had that doen i was facing a 235 dollar fine because back then in Ohio atleast in Cleveland they went by every 5 miles over you get a bigger fine and also every 5 miles over when your speeding by 10mph or more they can add more points on also
i lucked out it came back the cop had put off having his gun calibrated for over a year past the due date

the judge said u can go and had the baliff escort me out the back door did not want me going in the court room and shouting out how u just got out of a tiket just to help other ppl so he did not want me going back threw the court room during all this i was in his chambers me and the officer and the prosecutors cause in ohio we do not have DA's

so how did you get out of a tiket

I was ticketed for doing 81 mph on Interstate 95 between Richmond and D.C.. Just happened to be the one car in a gap between two groups (large) of cars going in excess of 80 mph. VA Trooper took off after me and I immediately pulled to the side of the road. The Trooper almost rear ended me as he pulled up behind me! Needless to say I was polite and took my medicine like a man. As luck would have it my daughter-in-law, who is an attorney got me "pro bono" representation from a lawyer in her firm. I had to appear in court before a judge. In the meantime I took a Driver's Ed course and had my speedometer calibrated. My speed exceed the speed limit by 15 mph (81 in a 65 mph speed limit zone) which in Virginia is an automatic "Misdemeanor" and has a severe impact on your insurance rates.

There was one problem with the copy of the ticket I received, it was illegible! Neither the attorney nor I could read what the Trooper had written. When the day of the court appearance came both the attorney and I showed up at the courtroom. I wore a suit with tie. The case was held in the Spotsylvania Courthouse. I think only the judge, my attorney and myself were wearing suits. The trooper was 1 1/2 hours late for case, the judge was not happy and took one look at the ticket, ask the trooper what it said and when the Trooper said he couldn't read it either, the judge dismissed the cased. As my attorney said, "I'll take lucky any day over brilliant!"

i have one time where i did not have to defend myself in it my uncle was a friend of the mayor for the mayors court of a town in cleveland
i got the tiket i knew i was speeding buy 13 over so i was not suprised to see it was actualy going to take my medicing and pay the tiket but then when my 2nd Cousine called his father and sai whats up he asked for the tiket number
so he could give to the mayor so the mayor could pull the tiket
told me to come in with 50 dollars to donate to the mayors Hunger for harfest fund and the tiket would be torn up when i got there i talked to his secretary and she was just going over some info
on it to veryfie it was the right ticket had my drivers license number down rightname and adress was correct
color of the car was wrong
but thats not something to get out of a tiket on
the part that got me out of even having ot pay the 50 for the donation if i didnt want to was the fact that he put the wrong plate number down on the tiket
she went back spoke to the mayor mayor came out and said don't worry if you went into court with this i would throw it out because the plate number is not even close to right so its a voided tiket ontop of it not having your signatur on it
in Ohio you don't have to sighn the tiket
aslong as they hadn it to you then its leagle
also cops in ohio can't say have a nice day after they right you a tiket cause thats toughting and being a smart ass they consider it lol
but anyways so he threw the tiket out told the cop what was going on
and then i was leaving forgot to give the 50 dollar gift card for giant eeagle to him pulled it out walked back and he said
no need for that you are cool i said well someone els has a need for it and not me so take it
ever since then the cops in that area have never messed with me again there are 3 citys that use that mayor court unless its a felony then they go downtown
but the 3 citys never mess with me even if i fly buy at 12 over never one time a cop got behind me with his lights ran the plate and
after he had me stoped for 2 minutes he just took off didnt even come to the car so i can only asume they have some sort of way to comunicate with each others city perhaps

this is not a defence so its not getting out of a tiket by a deffence its just to show that yes its good to know ppl
but also some cops and judges just arent asses if they mess up ona tiket they don';t fight it they know that its voided so there cool

Once received a bullcrap ticket on a road with no intersections within a mile of me in either direction for failure to stop at a stop sign. Now, the officer was following me for fifteen minutes before this and I just happened to be the ONLY Hearse driving through the historical district at 3 AM where the cemetery is. Initially, he told me I was stopped for not having my headlamps on, except they clearly WERE on and he realized that made no sense, but after asking me about fifteen times if I was transporting drugs or weapons in the car (Not an exaggeration, it was definitely more than ten) and getting the same answer of "No, Sir" he went back to his truck and returned with a ticket for passing that phantom stop sign that didn't exist in our plane of reality. He did however fail to correctly file the ticket's time and date and I had an airtight alibi for the time he wrote the for ticket's supposed occurrence. He just so happened to write a time and date in which I happened to be in front of The District Attorney the county court house for a case about an order of restraint, an hour away and was shown on record to have been there AND my vehicle was there in the event it needed to be used as evidence. Ticket was dropped altogether, no questions asked.

I can however probably fight a wrongfully issued ticket in Las Vegas any time I like, as I do not get tickets I actually deserve, I just get them for driving a suspicious Hearse, but I just happen to have a connection to a judge there with extensive judicial knowledge to act as an advisor, and he has extensive connections to the officials such as the city's lawyers, judges and Mayors, past and present as well as to a mysterious organization of people whom he sends to Europe to spy on what his daughter is doing in the Soho district of London, to Australia to run background checks on her penpal and to Pennsylvania to thoroughly investigate some Irish kid with a Hearse who grew up there. That and he is an avid fan of classic Cadillacs.

I was doing 94 in a 60. Passed an unmarked cop car (he was moving, not stopped), he pulled me over, asked me why I was in such a rush. I told him I was late to my class at the local fitness center and apologized profusely. He took my licence and insurance info, checked them all out, came back and gave me a ticket for 79 in a 60 because "I was a nice guy with no prior traffic tickets and it's about a $200 cheaper ticket". I was pretty happy with the way that turned out.

i wouldn't have been its not a not guilty finding your still guilty when you agreed to pay that 200 pay it wave it what ever

this is just to see if you have had any times at successfully getting out of a ticket period as in a not guilty finding or case being thrown out by the judge
and what you used as a defense

Not guilty.

But did it actually win your case or did the judge find you guilty even if you plead not guilty ?

Not guilty, case dismissed!

It was concerning a registration issue with the previous owner who kept the license plates & continued to use them after I titled & registered with new plates.

I had a DUI reduced to reckless driving. Blew 0.09(limit is 0.08), but I did wreck my Camaro. Had a hell of a lawyer who was basically very well connected with the judge. Still had to do 2 days in jail, 8 hour DUI course, probation, paid a big fine, but kept my liescense, and insurance only went up $250 every six months.

As far as I remember no other car was involved in the crash and it was just your car. So why those cops come and why they test you for DUI?

I was ticked for improper passing. Problem was, it was a passing zone with a broken line and I never exceeded the speed limit.

Hired an attorney, who promptly demanded the Mobile-vision footage from the squad car. It clearly showed a proper pass.

Went to court - got rescheduled - again and again. SIX times!!

Finally went to court, and the prosecutor was trying like anything to derail our case. He couldn't. Kicked them in the ass and walked away smiling. Cost me plenty, way more than the ticket, but right is right.

I've been lucky a couple of times.

About 10 years ago I had a 1989 Bentley Turbo R which was an intoxicating experience with its effortless turbo 6.75 litre V8 that caused the scenery to fly by so quickly, and I couldn't help myself being a maniac. As an Eglish car it usually had some kind of slightly annoying intermittent issue, and, of course, the day before a trip to northern Minnesota the cruise control would engage maybe one out of every hundred times the button was pushed. I drove with my brother about 200 miles to my Uncle's funeral, we dressed as classic blue bloods right out of a RL ad complete with some bottles of fine wine carefully resting on the back seat (unopened of course... :) ).

Anyway, I was rolling the car along on the interstate around 85+ when I saw a sheriff car go by in the other direction. I slowed down to the 70 speed limit for the next few miles, thankfully, because minutes later we rounded a curve and another sheriff car was parked on the shoulder as though hoping to catch me racing by, we passed, cop pulled out with lights flashing, pulled me over. We sat and sat waiting until another sheriff car pulled up, it turned out to be the sheriff from a few minutes earlier, he approached the car and asked me if I knew how fast I was going when I passed him a few miles before. I answered "in the sixties." The cop looked at me as though not knowing what to say, and I realized he was hoping I would admit to some speed - any speed - above the 70 limit so he could peg me with a ticket.

The cop tried to convince me to admit I was driving much faster, which I very kindly and innocently did not go along with. Frustrated, he took my license back to his car, meanwhile the two other cops were walking around completely gawking at my car, at the time there were hardly any Bentleys in Minnesota, much less like the exotic Turbo R. In the end I got a stern warning and off I went. Whew :)

Next one, about 5 years ago, driving my 99 Jaguar Vanden Plas, one of the headlights would once in a while not work, a good swipe of the palm would turn it back on.

I had drinks and dinner with some friends and drove home through a notorious little town that was known for stopping everybody and anybody for DUI. I only had a martini and a couple glasses of wine over nearly 3 hours so I thought I was fine. It was a summer evening just before dusk and I decided to drive through the little town instead of taking a route around thinking I was just fine. Of course, I pass the local police car on the side of the road, and, of course, the headlights came on automatically a few seconds before, and when I saw the cop do a U-turn to come after me I realized the light must be not working. The cop asks if I knew why he pulled me over and I said "the light" and then he asked if I had been drinking, I said no, then he said "I smell breath mints on your breath," I had an altoid minutes before, and he put me through the whole routine, and my rating was the slightest hair over the limit. He hauled me in.

By the time they did the official test at HQ my rating was significantly below the limit. I went home. My attorney got working on things and got the charge reduced to driving without proper illumination. I did not admit to drinking, the cop didn't say that he smelled alcohol on my breath - only breath mints, and my attorney vowed to fight the charges if the DA did not drop them. I was really lucky once again.

It's funny how experiences in life teach the hard lessons that make us realize what amount of grief we are willing to impose upon ourselves for the risks we take. :)

The "exotic car" look see on the part of law enforcement got me out of a ticket once too. I had pulled out, in my newly acquired Lamborghini 350 GT, on a long stretch of divided highway that dipped down into an arroyo before heading up a hill to a stop light. A great palce to let her rip! So I punch it, got through a couple of gears before a CHP with lights ablazing was on my tail. I pulled over immediately, before I kew there were two other CHP cars there and their drivers were at my door. They ask why I was speeding, I didn't realise that this vacant divede stretch of highway had 35 mph speed limit, I said I had just return from Vietnam (true) and had just gotten my car out of storage and was trying to test the new pugs I had just put in. They ask if I would open the hood, which I did very obligingly, they had fun looking at the 4 OHC V-12 inside .... then said smiling suggested I test mycar somewhere else and let me go without a ticket!

I never did get a ticket while driving the Lambo (should have a few times, but never did)!
