: Help - speeding ticket + advise in VA Needed

Hello all: I need some advise in the Northern Va area. True event not provoked or warranted though - just frustrated:

I was driving on Dulles toll road today returning from my mother (who is in ICU - Fairfax hospital) after two weeks of continuous night and day support and still ongoing. Today I slipped and was speeding as returing home. Got clocked at 92 in a 55. Don't know what to expect as I heard some stories that I better get a lawyer. Anyone in No. Va can help would appreciate it.

The officer was rather upset and wrote me up in addition to speeding for, Taillight film being illegal, exhaust (corsa) being too loud, and tint of 35% in the front driver and passenger window not legal. So - I got 4 tickets. Not a good day. Again would appreciate some good advice....

BTW: Took the taillight film off already and peeled of the window tint as well. Now looking into a way to show that I have a basic exhaust (I am puzzled as I thought corsa's were OK, BUT live and learn I guess).

um...... We'll one good side of it is that you have more fix it tickets than moving violations. I hope you know a peace officer of any kind because he can sign those off for you. and it sounds like u have already fixed two. As for the moving violation, driving school is out of the question; so it looks like you just need to pay the thing and hope your insurance doesnt go through the roof. If it was triple digits; then id get a lawyer, but obviously there is no need for one this time.

The fix it tickets are no big deal, he was just stacking the deck.

Depending on:

Can you afford it?

Got priors?

If you go to court and plead not guilty (by yourself) they will most likely make you a deal for traffic school and they will drop the speed.

If you don't have priors.

Your lucky you weren't doing a ton because then it becomes the discretion of the officer (in most states) as to whether you go to jail or not.

You should figure a lawyer is gonna cost you at least $500 right off the bat.

Isn't that a $1000ish ticket in VA with a $300 tax on your license for the next two years? From what I've read VA is one F'ed up state socialist state. Better get lawyer!

First off don't even think of not fighting this! If you are in the Leesburg area my father used a guy that is very good at these. PM for the name. There is a reason those of us that got the hell out of up there call it the "Communistwealth of Virginia". VA troopers are as bad or worse than most others. I would pay big bucks just to knock his little smokey the bear hat off of his 14 yr old head. In any case I'm sure I'll get hell for disrespecting law enforcement.

Also to the gentleman that suggested getting a V1, I'll refer back to my communist comment above... radar detectors are illegal in VA. I don't drive without a V1!!!!!!!!

Get a lawyer.

Get the options list on the V, showing that the corsa was available as an option from the factory/dealership. That will help with that.

Get a lawyer.

VA is a nazi state for speeding, and judges like to hammer it home.

That sucks. Definitely talk with an attorney. I was able to get mine knocked down from reckless driving to a simple speeding ticket (142 in a 65).

I'm not sure what to do with the exhaust issue. I know that a cammed V with Kooks and Corsa is NOT very quiet.

I bought my V in FL and not even a day into ownership driving it home to CT, I got stopped in VA doing 88 in a 65. they hit me with wreckless driving and wreckless speed. Thankfully, I have a few lawyers in family and put me in contact with attorneys in VA. Basically, I had to do an online driving school, show a letter stating that I committed community service. I also had a clean driving record. However, the judge took my case under advisement, meaning i could have no violations for the next 6-months. After the 6-months expired, the case was dropped. It SUCKED having a brand new V and having to drive it conservative the first 6months of ownership... but it was well worth it getting the ticket dropped... supposedly wreckless driving carries the same offense as a DUI in other states...

I spent 4 years going to college in Virginia and the troopers are BRUTAL down there. I also have 2 illegal radar tickets under my belt down there. But if you drive fast, in my opinion, it's worth a 40 dollar ticket for a radar detector rather than getting speeding tickets like this. A lot of cops will just give you a warning anyway. Most of the time you can just yank the radar detector down and stuff it in the center console before you get pulled over. That's what I always did, (except for the few times I didn't have time and therefore got the tickets). As long as it's not near a power source you should be fine. Hope you get off this man! That's a tough ticket.

I live in NVa also. Get the lawyer now. It has been many years since I had a speeding ticket but I recall a ticket of your size is $2500 + 30 days jail time (sort of like a DUI). They usually suspend the jail time and some money depending on your record. I believe you will get 6 DMV points and 2 insurance points for that ticket. The insurance points may end up costing more than the ticket over a few years. Sorry for the bad news.

The state and county make a lot of ticket money off that road as I see someone getting a ticket nearly every day. Not that it will do you any good now but PM me and I can give you at least 7 places they sit on the Dulles toll road.

DON'T PAY ANY TICKETS!!!!
Give them to a traffic lawyer. They can fight it for you and there is a 50/50 chance you will get it
dismiss. By getting it dismissed, you will never have it in you driving record.
IF YOU PAY, you are automatically declaring yourself guilty of such infractions!!!
By means it will be in your driving record.
What the lawyer garranties is that you will not get any points on you DL and you dont have to
attend to a traffic school. There is a chance to have to pay some court cost.
Personally I have had all my tickets taken care by a lawyer and My driving record is clean, yet I have had about 5 tickets in my driving time.

Cop must have been pissed, usually at the agency I work for if you stop someone for really speeding you knock it down a violation or two and say 65 in a 55 or something.

For those saying the cop shouldnt have done what he did, the OP was going 92 in a 55, i feel for the OPs situation but thats a bit much. Good luck though.

It's because of threads like this, I refuse to visit and avoid states like Virginia. If I was driving thru Virginia because I had (for example if Work required it on a business trip) to and got pulled over I'd tell the LEO that point blank.

Other than that, I try to avoid CA but for other reasons!

guys - Let's not get into how bad and tickets who got the worst. I appreciate all's feedback and support. Again, I have been having a bad year with family issues. I so look forward to the track days at summit. That is thee only place to go fast and test out your cars (also other tracks as well). I just needed advise on what should I do next.

Update:

Got myself a lawyer:
Got a letter from the Hospital on how many days and nights I have been awake: I really did not know how fast I was going...
Got my speedometer calibrated: it is 2 MPH over the actual - that helps
Went to Lindsay to see if there was any leak in my corsa system to ensure I don't have added noise. All Clean
Got a copy of my driving record:
swapped out my taillights without the tint:

ANYONE Here can find the location of our cars - where GM was offering the upgraded exhaust system as a GM accessory. I know I have seen it, but can't find an offical site at GM or cadillac.

On major hwy's radar detectors are a joke...lazer jammers are the only way to go...radar dectors are a thing of the past...If u are the lead car.once the po hit's u with it your toast.. same with the lazar.. once he picks u out and u have a rd and speeding your toast...I personally have a binder35 lazer jammer. and when i am the lead vehicle and he hits me the jammer it just beeps it's ass off. the more it beeps the more i LMAO cause he can't get a reading....i love it....I don't sell them. but i use one and it is the only way to go.. i found out info. on the lazer jammer on a website called, i think www.speedtraphunters.com. ps: i have a top of the line escort rd and it's just sits in my garage collecting dust and that's all it's good for.:thehand:
Also Mick, get a good local county traffic attorney...he knows not only the ropes but the local judges.. most of the time if he sees on the dockit a judge he doesn't like he will postpone until he gets the judge he plays golf with every Sunday. Good luck, everything will work out fine:thumbsup:
