BBB CASE#: 90106775
Complaint filed against: Murphy Cadillac, Inc. (More)
Complaint status: Forward Business response to Consumer (More)
Case Description: Murphy Cadillac charged me $109 for an item covered by warrany.
On Wednesday April 3rd I brought my 2006 Cadillac DTS with 65,000 miles on it for servicing of the emissions system which has an 8 year/80,000 mile warranty. The vehicle had a yellow emission light on for the catalytic converter. I was told the computer had to be reflashed as the parameters for the failure have changed due to more ethanol in the gas that is now made. The warranty states that all parts associated with the emissions are covered including diagnostics, adjustments and software. Ive gone through all the steps for filing complaints with Cadillac and was offered a $100 gift certificate towards my next visit. I will never go to that dealer again. (Less)

RESPONSE BY CADILLAC DEALER:
On April 11, 2013, the business provided the following information:
Upon review of the situation Murphy Cadillac has determined that we did make a mistake in not charging Cadillac for the repair and by charging the customer. We will be issuing a check for Mr. Mxxxxx refund on the item in question. I would like to state that Murphy Cadillac has been in business for 44 years and maintains an A+ rating with the BBB by doing the right thing by our customers. This sincerely was a mistake.
I was trying to post on threads concerning this code to let owners know what may happen when they take there car to the dealership. It was not an oversight by the service writer by any stretch. Its a scam that Im sure others have suffered from. Several calls to Cadillac and each supervisor gave me the same response "It is not covered". Anyone that can read and has an IQ above 50 knows that it is covered. I have not been reimbursed as of now. They sure don't have a problem calling you to come and pick up your car when you owe them money. They sure haven't called to ask me to pick up my check. I wonder how many people have paid for this software reflash not knowing it is covered by the warranty. Anyway, I will let it rest. I wasn't trying to upset any of the daily forum veterans just trying to help my fellow owners. Peace
My name is Kevin Murphy and I own the dealership Murphy Cadillac in Melbourne, FL where this incident happened. I wanted the record to be straight- we made a mistake and we handled it. The customer filled a BBB case before even calling the dealership and talking to me or the service manager. I refunded him promptly after we verified that we made a mistake. We are as human as the next guy and mistakes do happen, it's how you handle the mistake that makes the difference. Again we have an A+ rating with the BBB and have been in business for 44 years. You can't do either of those two things by treating people the wrong way. This was not a scam as Shym3 indicated. Thank you.
