Actually, it's already been addressed with the recall on the pinion seal leakage. The recall notice said that low fluid due to the leaky pinion seal could cause the diff to lock up and result in a loss of control.
Consider that recall officially washing their hands of the issue. The car is obsolete and not made any more, and they've covered themselves from a safety standpoint, which is all they need to do to remove liability. The NHTSA does not care that your diff won't handle a drag launch or wheelhop- only that it's safe under normal driving conditions.
